The “website,” or “site” refers to the Payless retail website for our customers in Costa Rica. “User,” or collectively “Users,” refers to any party who accesses the site. “Payless” refers to Payless ShoeSource, Limitada, and its parent company, affiliates and licensees. “Access” means viewing or otherwise obtaining information located on the Payless Costa Rica website. “Agreement” refers to these Terms and Conditions and any subsequent modifications.Payless reserves the right to modify this Agreement at any time, including imposing a fee to access certain materials contained on the site. Any change in this Agreement is effective immediately upon User's receipt of notice from Payless. Notice can be given through e-mail, posting on the site, or any other means by which User may obtain notice. Users should periodically review this Agreement for changes. Any use of the site after changes have been made shall be deemed acceptance of the changed terms of this Agreement. Payless reserves the right to monitor use of the site.

Payless has the exclusive right to control accessibility, hours of use, features on the site, and any other information found on the site. Payless may restrict access to any or all portions of the site or remove any information or content from the site at any time.

If you establish an account at this site in order to purchase products or receive information from us, you are responsible for maintaining the confidentiality of your account and your password. Any personal information provided in the account will be governed by the Privacy Policy, which can be found here. By establishing an account, User agrees to accept responsibility for all activities that occur at the site under your account and password. Payless reserves the right, in its sole discretion, to refuse service, limit quantities, cancel orders or terminate your account. Rain checks are not available for any merchandise shown on this site should we run out of inventory. User is solely responsible for providing the equipment and software related to accessing the site, including all computer, remote communications equipment, telephone or other equipment.

PURCHASING INFORMATION

Promotions

From time to time, the Payless Costa Rica website features various promotions. These promotions may include "free" offers, coupons or other similar types of promotions. We have established a few simple rules that apply to these promotions:

All promotions are subject to these Terms and Conditions as shown on this site.
We reserve the right to limit quantities purchased.
All promotions are for a limited period, and the dates covered by the promotion are listed on this site. If the dates are not specified for a particular promotion, that promotion shall end after 14 days.
Various promotions have minimum purchase amount requirements. Those requirements are set forth as part of the online promotion description.
At times, we run two or more promotions simultaneously. We state as part of the online description of a promotion whether it can be used in combination with another promotion.
Unless otherwise stated as part of the promotion description, all promotions require a purchase.

Coupons

All terms stated on a printed coupon that may be used for web store purchases also apply to use of the coupon through the website.
Any use of a coupon for products other than those indicated is not permitted.
You are responsible for any applicable sales tax.
Coupons issued in Costa Rica are only valid for Costa Rican stores. Coupons obtained outside of Costa Rica are not accepted for purchases from this website.
Refunds for items purchased through this site using a coupon will be at the price actually paid for the item, not at the full price.
Only one coupon may be used for each website transaction unless otherwise stated in the coupon’s terms and conditions.
A transaction occurs when you fully complete the checkout process.
Coupons are not redeemable for cash.
The website does not accept coupons from issuers other than Payless ShoeSource, Limitada and its affiliated entities.

Free Items

You may receive one or more "free" items with each online transaction subject to the terms and conditions of the promotions in effect at the time of the transaction and these “free” items may not be returned except for “Buy 2, Get 1 Free” promotions as described below.
When you receive a "free" item as part of a promotion, you are not charged shipping or handling fees for that "free" item.
The exception to the above "free" item rules is the "Buy 2, Get 1 Free" promotion offered occasionally to our shoppers. If you place a qualifying order and receive a free item in this promotion, you will be charged shipping and handling for the free item. If you are not satisfied with the fit or quality of the free item in this instance your sole remedy is to exchange the item for another item of equal or lesser regular price value. Pricing

Prices on this website may differ from pricing in Payless retail stores, and the prices on this site apply exclusively to this website and will not apply in Payless retail stores.

Warranties

Merchandise purchased from this website is warranted against defects in materials and workmanship for thirty business days from the date of purchase on your receipt. The complete warranty policy can be viewed at Return, Exchanges and Warranty Policy page.

General Matters

Payless will ship your purchase to a nearby store for pick-up or to a location of your choice.
The details about taxes, shipping charges and estimated delivery dates will be described in this website when a customer places a product in the Cart and can also be viewed at FAQ and Delivery policy pages.

PAYMENT METHOD SECURITY

Payless.cr accepts, Visa, Mastercard, Bank Wire payments and cash on delivery. Payless has implemented effective, trustworthy, and certified security systems to protect the security, integrity, and confidentiality of any transactions and payments carried out by consumers. Once the User has clicked on the "Process Purchase" button on the website, the User will get a permit from the trading company of your credit card for the amount indicated on the order summary page. If your credit card is not authorized, the order will not be processed.

The payment by credit card transaction is processed in an encrypted form through a bank validation server, using encryption protocol SSL (Secure Socket Layer). The number of your credit card and the expiration date are instantly encrypted on your computer before being sent to the SSL protocol. No one may make use of your data without your permission, since the information is unreadable. For added security, the credit card data is not stored on the Payless server, so you must enter all the credit card information each time an order is placed.

PROHIBITED CONDUCT AND COMPLIANCE WITH LAWS

You expressly agree that you will not do, either personally or through an agent, any of the following:

Use any device or other means to harvest information about other Users.
Transmit, install, upload or otherwise transfer any virus or other form of malicious software, item or process to the site that in any way affects the use, enjoyment or service of the site or any User's or Payless employee's computer or other medium used to access the site.

Payless ShoeSource, Limitada, its affiliates, and its content providers are not responsible or liable to any person or entity whatsoever for any direct or indirect loss, damage (whether actual, consequential, punitive, special or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from User’s opinions placed on the website or from the use of, or the inability to use, the site or from any Payless information. You specifically agree that Payless is not liable for any defamatory, offensive or illegal conduct of any User.

CONSUMER CLAIMS

If you have concerns about our site, we encourage you to contact us. Payless has established a free, transparent, and effective mechanism to receive complaints and claims from consumers, which can be found here. The response times for the complaint will be between 5 and 10 business days depending on the case involved. In order to process the claim, the customer will need to submit their case in the following link. You may submit a claim by mailing Payless at San José, Escazú. Avenida Escazú, Torre Lexus, Segunda etapa, Piso 4, Oficina 204 or by contacting Customer Service at: 506-7114-4227 (8:00 AM – Noon and 1:00 PM – 5:00 PM, Central Time, Monday - Friday; and 8:00 AM – 11:00 AM and Noon - 1:00 PM, Central time, Saturday). Any disputes that may arise between Payless and our customers will be subject to and resolved according to the laws of Costa Rica.

TERMINATION OF AGREEMENT

These Terms and Conditions will continue as an agreement between Payless and you until we terminate them, which we may do at any time without notice to you, which will not affect any contractual or consumer rights that we may have acquired with you. We also may terminate your right to use this site immediately and without notice to you if, in our sole discretion, you fail to comply with any of these Terms and Conditions. If we do terminate your right to use this site, then you are no longer authorized to access or use any of the benefits of this site. In addition, the restrictions we have imposed on you concerning copying or downloading information, and the disclaimers and limitations of liabilities that we have stated in the Terms and Conditions, will survive our termination of the Agreement. The Terms and Conditions that we have stated in this site are the entire agreement between us relating to each of the issues discussed in these Terms and Conditions.
